Dear Guest

This Rental Agreement and Contract (the “Agreement”) is a legally binding agreement made and entered into as of the {check_in_date} by and between the undersigned person(s) {guest_first_name} {guest_surname} or company (the “Guest”) and the undersigned owner, manager or agent ("Owner”), pursuant to which the Guest has agreed to rent the holiday rental described below (the “Property”), for the duration of the Rental Term for the Total Rental Fee and other good and valuable consideration as described herein.

 

OCCUPANCY

  • Occupancy. Guest agrees that no more than the invoiced number of persons shall be permitted on the Property at any time during the Rental Term, all of whom shall comply with the conditions and restrictions imposed upon the Guest under this Agreement. The property will only be prepared for the number of people you have paid for.

 

USE

  • Property Use Restrictions: The Property is for residential use only. It shall not be used for any of the following purposes:

    • Events or gatherings that are likely to cause a significant disturbance to neighbours, including Male-only groups, Stag Parties, or Bachelor Parties.

    • Any commercial activities (e.g., parties, filming).​

    • Any illegal or immoral purposes.

CONDITION AND USE OF THE PROPERTY

  • Condition and Use of the Property. The Property is provided in “as is” condition. The Owner shall use its best efforts to ensure the operation of all amenities in the Property, such as internet access, satellite or cable TV access, hot tubs, and fireplaces, as applicable. The Owner shall not be held responsible for such items' failure to work but will make every effort to correct any issues reported as quickly as possible.

  • The Guest acknowledges that using amenities such as hot tubs, pools, spas, fireplaces, cots, high chairs, and the like may be potentially dangerous and involve potential risks if improperly used, particularly with regard to children. Such use is at the Guest’s own risk. The Guest agrees to be responsible for any damage or injury resulting from the use of such amenities, excluding normal wear and tear and agrees to report any damage within 24 hours of occurrence.

 

QUIET HOURS & ENJOYMENT

  • Quiet Hours. The property is in a residential area. The Guest agrees to abide by local noise ordinances and to be respectful of neighbours. Excessive noise, disturbances, or parties that result in neighbour complaints may be grounds for immediate termination of this Agreement. Quiet hours are in effect from 21:00 (9:00 PM) each night until 07:00 (7:00 AM). During quiet hours, the Guest and their visitors shall keep noise levels to a minimum to avoid disturbing neighbours.

 

RESIDENTIAL USE

  • Residential Use. The Guest shall use the Property for residential purposes only and in a careful manner to prevent any damage or loss to the Property and keep the Property in clean and sanitary condition at all times. The Guest and any additional permitted guests shall refrain from loud noise and shall not disturb, annoy, endanger, or inconvenience neighbours, nor shall the Guest use the Property for any immoral, offensive or unlawful purposes, nor violate any law, association rules or ordinance, nor commit waste or nuisance on or about the Property.

 

TERMINATION

  • Termination. The Owner may terminate this Agreement upon written notice to the Guest if the Guest violates any terms of this Agreement or in the event of non-payment of rent. In such case, the Guest shall forfeit all Rent and the security deposit. If any legal action is necessary to enforce this Agreement, the prevailing party shall be entitled to reimbursement from the other party for all costs incurred.

 

PETS

  • Pets. The Guest may bring up to two (2) pets to the Property. For the right to have a pet(s) on the Premises, the Owner shall charge a non-refundable fee of £50 per stay. The Guest is responsible for all damage that any pet causes, regardless of its ownership, and agrees to restore the Property to its original condition at their expense.

 

SMOKING

  • Smoking. Smoking is strictly prohibited at the Property. Any Guest caught smoking or determined by the housekeeping staff to have smoked at the Property shall be subject to an additional cleaning fee of £100 per affected room.

 

WASTE

  • Waste. The Guest shall dispose of all waste material generated during the Rental Term in accordance with the property's handbook.

 

DAMAGE

  • Damage. The Guest agrees to be responsible for any damages to the Property caused by the Guest or their guests during the rental period. The Owner may deduct the cost of repairs or replacements from the security deposit. If the damage exceeds the security deposit amount, the Guest agrees to pay for the additional cost of repairs or replacements.

 

SECURITY DEPOSIT

  • Purpose: The Guest shall pay a Security Deposit of £800 to the Owner. This deposit is held to cover the cost of any potential damages to the Property, excessive cleaning, violations of the Agreement's terms, or unpaid charges incurred by the Guest during the Rental Term.

  • Timing: The Security Deposit will be automatically charged 24 hours prior to check-in.

  • Itemized Deductions: Upon checkout, the Owner will inspect the Property. If any damages (beyond normal wear and tear), excessive cleaning needs, or violations are found, the Owner may deduct the necessary costs from the Security Deposit. The Owner will provide the Guest with an itemized list of any deductions within 5 days of the Rental Term's end.

  • Refund: Any remaining balance of the Security Deposit will be automatically refunded to the Guest within 5 days of the Rental Term's end, provided there are no deductions.

ENTRY AND INSPECTION

  • Entry and Inspection. The Owner reserves the right to enter the Property at reasonable times and with reasonable advance notice to inspect it or show it to authorised persons. If the Owner has a reasonable belief that there is imminent danger to any person or property, the Owner may enter the Property without advance notice.

 

UNAVAILABILITY OF PROPERTY

  • Unavailability of Property. In the event the Property is not available for use during the Rental Term due to reasons, events or circumstances beyond the control of the Owner, the Owner will apply due diligence and good faith efforts to locate a replacement property that equals or exceeds the Property with respect to occupancy capacity, location and value that meets the reasonable satisfaction of the Guest. If such replacement property cannot be found and made available, the Owner shall immediately return all payments made by the Guest, whereupon this Agreement shall be terminated, and the Guest and the Owner shall have no further obligations or liabilities in any manner pertaining to this Agreement.

 

GENERAL PROVISIONS

  • This Agreement contains the entire agreement between the parties with regard to the rental of the Property, and any changes, amendments, or modifications hereof shall be void unless the same is in writing and signed by both the Guest and the Owner.  The words “The Owner” and “Guest” shall include their respective heirs, successors, and representatives. The waiver or failure to enforce any breach or provision of this Agreement shall not be considered a waiver of that or any other provision in any subsequent breach thereof. If any provision herein is held invalid, the remainder of the Agreement shall not be affected. Any notice required to be given under this Agreement shall be in writing and sent to the contact information included herein. This Agreement may be signed in one or more counterparts, each of which is an original, but taken together, constitute one in the same instrument.

GOVERNING LAW AND JURISDICTION

  • This Agreement shall be governed by the laws of England and Wales, and any disputes arising under it shall be resolved in the courts of England and Wales.

 

RISK OF LOSS AND INDEMNIFICATION

  • The Guest agrees that all personal property, furnishings, personal effects and other items brought into the Property by the Guest or their permitted guests and visitors shall be at the sole risk of the Guest with regard to any theft, damage, destruction or other loss and The Owner shall not be responsible or liable for any reason whatsoever. The Guest hereby covenants and agrees to indemnify and hold harmless the Owner and their agents, owners, successors, employees and contractors from and against any costs, damages, liabilities, claims, legal fees and other actions for any damages, costs, legal fees incurred by the Guest, permitted guests, visitors or agents, representatives or successors of the Guest due to any claims relating to the destruction of property or injury to persons or loss of life sustained by the Guest or family and visitors of the Guest in or about the Property and the Guest expressly agrees to save and hold the Owner harmless in all such cases.

 

SEVERABILITY

  • If any provision of this Agreement is deemed invalid or unenforceable, that provision shall be severed from the Agreement, and the remaining provisions shall remain in full force and effect.

 

SIGNATURE

By signing below, the parties acknowledge that they have read and understand this Agreement and agree to be bound by its terms.

Execution of a digital signature shall be deemed a valid signature.
